On 11 December 2020, Willoughby City Council visited Mowbray Eatery and issued five infringement notices totalling $4400.00. This has resulted in Mowbray Eatery being listed on the NSW Food Authority Name and Shame list.
Five Infringement Notices Issued
The infringement notices were issued for the following reasons:
Fail to ensure food contact surfaces of equipment is in a clean and sanitary condition – previous warning given
Fail to take all practicable measures to eradicate and prevent the harbourage of pests – previous warning given
Fail to maintain the food premises to the required standard of cleanliness – previous warning given
Fail to maintain all fixtures, fittings and equipment to the required standard of cleanliness – previous warnings given
Fail to maintain easily accessible hand washing facilities on the food premises
Name and Shame List
Not all offences are recorded on the name and shame list. A business will be noted if:
Enforcement officers use a graduated response for alleged breaches of food law that may increase in severity depending on the circumstances. Factors taken into consideration include, but are not limited to:
- whether a warning has previously been given
- whether the breaches pose a serious risk to public health or significantly mislead consumers
- the number of breaches or repeat offences.
The Food Authority’s policy for deciding the appropriate enforcement action for a particular case is found in the NSW DPI Biosecurity and Food Safety Compliance Policy and Enforcement Policy.
In April 2008, New South Wales was the first State to establish a ‘name and shame’. The reason for publishing these lists is to give consumers more information to decide where they eat or buy food.
ITC regularly checks this list, and we have not seen a Lane Cove eatery on this list for at least the last three years.
