Lane Cove North neighbour dispute over 3cm carport post dismissed

Community News news brief

A Lane Cove North woman who sued her neighbours over a carport post sitting 3cm on her land has walked away with nothing. The NSW Supreme Court dismissed her claim and ordered each side to pay its own costs.

A survey she commissioned in 2022 ahead of a new dividing fence found the neighbours’ garage eave and gutter crossed the boundary by about 13cm and a carport post by 3cm. The structures had stood since 1984.

She went to court in July 2025 seeking about $56,600 including aggravated damages and turned down a $20,000 offer to settle. The judge found the neighbours had worked to remove the encroachments and that they were minor with no serious impact on her use of the property.
