New Short Term Leasing Legislation
Do you run an Airbnb or another short stay accommodation premises? Have you ever complained about short term rental premises? The NSW State Government will be introducing new legislation to limit the number of days premises can be rented out via a short term rental arrangement.
The statewide policy for homeowner holiday rentals has been finalised, giving the industry four months to implement the new changes.
The Department of Planning, Industry and Environment’s Deputy Secretary of Planning and Assessment Marcus Ray said the final Short-Term Rental Accommodation (STRA) policy will benefit homeowners looking to rent out their homes for extra money while providing more certainty and safety for locals and visitors.
“This new framework follows extensive consultation with the community and the holiday-letting industry and we’re proud to finally have a clear set of rules that support the $30 billion a year industry while protecting the rights of hosts, guests and neighbours,” Mr Ray said.
“This framework includes limits on the number of days’ properties can be rented out in certain circumstances, new fire safety standards, a government-run register, mandatory Code of Conduct and an exclusion register to ensure properties are up to scratch.
“The sector has suffered significantly during the pandemic but our whole-of-government approach will help get businesses and homeowners back on their feet.”
The final STRA policy includes:
- A cap of 180 days for homes across Greater Sydney, and parts of coastal and regional NSW, where the owner lives elsewhere;
- Hosted STRA homeowners being able to rent their homes out 365 days of the year;
- Minimum fire safety standards; and
- A Code of Conduct for hosts, guests, online booking platforms and agents.
The Department received more than 2000 submissions in response to the initial framework and since has been working with councils, the industry and working across government to resolve the complex issues that were raised.
The policy comes into effect on 30 July 2021 to give businesses and homeowners time to understand their requirements.

A Good Deed
The following was posted on Lane Cove Chat by ITC
“Just wanted to share a post my partner made last night. It speaks volumes about our wonderful community.
A nasty car accident happened right in front of me tonight. Small car, P-plate driver, turns and a delivery driver on a moped rams up his side. Comes off second best, rider hits the road hard.
I race up, check him out. Blood all over his face, nasty cuts, he’s groaning. I get him stable, start calling an ambulance. Instantly another bystander comes up, says “I’ll handle the phone, you work on him”.
Two minutes later a woman appears beside me. “I’m a GP, need any help?”
“Thank God you’re here. He looks concussed, he’s not making much sense.” We ask questions but he clearly has little English.
Another young woman appears in a nurse’s uniform. Figures out he’s speaking Spanish. She speaks Spanish too. We make progress.
“Phone”, he asks.
I extract his phone from the demolished moped. He hits a button and brings up a number. I start calling it. His girlfriend, just up the road. She hurries to the scene.
By now police are on the scene. They’re pretty chill. They attend to the car driver, a young kid, clearly distraught.
Meanwhile the GP, nurse and I start on cleaning his wounds – a first aid kit has appeared out of nowhere, not from any of us – before the Ambulance shows up.
In the next ten minutes we have a towie, translator, and an off duty paramedic add to the assistance.
We hear a lot about how terrible we can be to each other, but in the space of little under 15 minutes on a quiet Northwood street a man seriously injured is surrounded by ordinary people with the precise skills and will to help him.
That makes me feel good.”
